Terms of Use
1.Acceptance of Terms
These Terms of Use (the "Terms") form a binding agreement between you ("you" or "your") and EA Architecture (operating as Elmira Aghsaei Architecture, "we," "our," or "us") governing your access to and use of the website located at eadesign.ca and any related online content, social media accounts, or digital properties operated by EA Architecture (collectively, the "Website").
By accessing or using the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Website.
These Terms apply to your use of the Website only. Architectural services provided by EA Architecture are governed exclusively by a separate written client services agreement signed between EA Architecture and the client. Nothing on the Website creates a client engagement, fiduciary relationship, or contract for architectural services.
2.Eligibility
You must be at least the age of majority in your jurisdiction (19 in British Columbia) to enter into a binding agreement. By using the Website, you represent that you meet this requirement, or that you are using the Website under the supervision of a parent or guardian who agrees to these Terms.
3.Permitted Use
You may access and use the Website for lawful, personal, or business-research purposes related to learning about our practice, viewing our work, contacting us, or booking a consultation.
You may not:
- Reproduce, republish, distribute, or commercially exploit any part of the Website without our prior written consent
- Modify, adapt, translate, or create derivative works from the Website or its content
- Reverse-engineer or attempt to derive the source code of the Website or any underlying systems
- Use the Website in any manner that violates Canadian, provincial, or municipal law, or any applicable foreign law
- Attempt to gain unauthorized access to any part of the Website, its servers, or any connected system
- Interfere with the operation of the Website, including by introducing malware, conducting denial-of-service attacks, or transmitting unsolicited communications
- Use automated tools (including scrapers, bots, or crawlers) to access, copy, or harvest content, except for legitimate search engine indexing in accordance with our robots.txt directives
- Misrepresent yourself or your affiliation with any person or entity in any communication submitted through the Website
- Use the Website to engage in unlawful, fraudulent, defamatory, harassing, or harmful conduct
We reserve the right to investigate and take appropriate action against any violation of these Terms, including reporting suspected unlawful activity to law enforcement and pursuing civil remedies.
4.Intellectual Property
4.1 Our content
All content on the Website, including but not limited to text, photographs, drawings, renderings, project descriptions, video, audio, graphics, logos, the EA Architecture name, and the underlying design, code, and structure of the Website, is owned by EA Architecture or licensed to EA Architecture. This content is protected by Canadian and international copyright, trademark, and other intellectual property laws.
4.2 Limited licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Website on a personal device for the permitted purposes set out in Section 3. This licence does not transfer ownership of any content.
4.3 Project attributions
Certain projects featured on the Website were carried out by Elmira Aghsaei in the course of employment with prior firms. Where such projects appear, they are clearly attributed to the firm at which the work was completed (for example, "Experience while at former employer, Revery Architecture"). Original copyright and authorship credit for those projects remain with the attributed firm. EA Architecture displays such projects solely to reflect Elmira Aghsaei's professional career experience and not to claim authorship of the projects on behalf of EA Architecture.
4.4 Submissions
If you send us project information, photographs, or other materials through the Website, by email, or otherwise, you confirm that you have the right to share that material and grant us the right to use it for the purpose of responding to your inquiry. We will not use submitted materials for any other purpose without your consent.
5.No Professional Advice
The content on the Website is provided for general informational purposes only. It does not constitute architectural, engineering, structural, building science, legal, financial, real estate, planning, or zoning advice. Project examples are descriptive of completed or in-progress work and do not represent guarantees, commitments, or predictions of outcomes for any future project.
Architectural services are provided only under a written client services agreement, executed by an authorized representative of EA Architecture. Reliance on Website content in lieu of engaging a registered architect or other appropriate professional is at your own risk.

6.Third-Party Links, Services, and Platforms
The Website may contain links to, or be embedded with content from, third-party platforms including Calendly, Instagram, LinkedIn, and others (each, a "Third-Party Service"). Third-Party Services are operated by independent organizations under their own terms and privacy policies. We do not control, endorse, or assume responsibility for any Third-Party Service or any content, product, or service available through them.
Your use of any Third-Party Service is at your own risk and subject to that service's terms.
7.Availability and Changes to the Website
We make reasonable efforts to keep the Website available and up to date. We do not guarantee that the Website will be uninterrupted, error-free, or free of harmful components. We may modify, suspend, or discontinue any part of the Website at any time without notice.
8.Disclaimers
To the maximum extent permitted by law:
- The Website and all content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, currency, non-infringement, or uninterrupted operation
- We do not warrant that the Website is free from viruses, malware, or other harmful components
- We do not warrant that information on the Website is accurate, complete, or current at any given time
Some jurisdictions do not allow the exclusion of certain implied warranties, in which case the exclusions in this section apply only to the extent permitted by law.
9.Limitation of Liability
To the maximum extent permitted by law, EA Architecture, its principals, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunity, or goodwill, arising out of or in connection with your use of, or inability to use, the Website, even if we have been advised of the possibility of such damages.
In no event will our aggregate liability for any direct damages arising out of or relating to the Website exceed one hundred Canadian dollars (CAD $100).
This limitation does not apply to liability that cannot be excluded or limited under applicable law, including liability for fraud, fraudulent misrepresentation, or any liability that BC consumer protection legislation prevents from being limited or excluded.
10.Indemnification
You agree to indemnify, defend, and hold harmless EA Architecture, its principals, employees, contractors, and agents from any claim, demand, loss, or damage, including reasonable legal fees, arising out of or relating to:
- Your breach of these Terms
- Your misuse of the Website
- Your violation of any applicable law or any third party's rights, including intellectual property and privacy rights
11.Governing Law and Jurisdiction
These Terms are governed by, and construed in accordance with, the laws of the Province of British Columbia and the federal laws of Canada applicable in that province, without regard to conflict-of-laws principles.
You agree that any dispute arising out of or relating to these Terms or your use of the Website will be subject to the exclusive jurisdiction of the courts of the Province of British Columbia, sitting in the City of Vancouver. You waive any objection to that jurisdiction or venue on grounds of inconvenient forum.
Nothing in this section limits your rights under applicable consumer protection legislation that cannot be waived by contract.
12.Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
13.Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and EA Architecture regarding your use of the Website, and supersede any prior agreements or understandings on that subject.
14.Changes to These Terms
We may update these Terms from time to time. The "last updated" date at the top of this page reflects the most recent revision. Material changes will be posted prominently on the Website for at least 30 days following the change. Continued use of the Website after a change becomes effective constitutes acceptance of the revised Terms, to the extent permitted by law.
